OUT OF DATE DUE TO TEXAS VACATUR OF 2024 ADMINISTRATIVE CLOSURE RULE
The Coalition is working on updating our Quick Guide.
On June 22, 2026, the state of Texas and America First Legal sued the federal government arguing that the administrative closure regulations are unlawful and should be vacated. On the same day that the lawsuit was filed, Texas and the Department of Justice jointly moved for a consent judgment, and a federal district court judge in the Northern District of Texas entered an order which states, “The Administrative Closure Rule is hereby vacated.”
There has not yet been any publicly available guidance from EOIR on the implementation of the vacatur and it is not clear what regulations have been vacated.
In addition to citing relevant circuit court authority and pre-2024 regulations on IJs’ authority to manage their dockets, e.g. 8 CFR § 1003.10(b), practitioners should cite relevant pre-2024-regulation agency decisions, such as Matter of Cruz-Valdez, 28 I&N Dec. 326 (A.G. 2021), and Matter of Avetisyan, 25 I&N Dec. 688 (BIA 2012), on administrative closure, and Matter of Coronado Acevedo, 28 I&N Dec. 648 (A.G. 2022) on termination, and any relevant U.S. court of appeals precedent recognizing termination or administrative closure.
